Legal Disclaimer
Please read this disclaimer carefully before submitting any 3D model, file, URL, image, design, or content to ABHITA 3D Printing. By placing an order, you acknowledge and accept the terms below.
1. Manufacturing service only
ABHITA is a contract manufacturing service. We operate 3D printers and laser equipment to produce physical objects from digital files provided by customers. We are not the creator, designer, or licensor of the 3D models we print, unless explicitly stated.
Analogous to a print-on-demand T-shirt service, photocopying shop, or job-work fabricator: we manufacture what you submit; we do not create, license, or own the underlying design.
2. Customer warranty of rights
- You are the original creator and copyright holder of the design
- You have explicit written permission from the rightful owner
- The design is published under a license (e.g., Creative Commons) that permits commercial 3D printing for the purpose you've requested
- The design is in the public domain
3. Indemnification
You agree to indemnify, defend, and hold harmless ABHITA 3D Printing, its owners, employees, contractors, and agents from and against any and all:
- Claims, demands, or lawsuits brought by third parties
- Damages, losses, costs, or expenses (including reasonable legal fees)
- Cease and desist notices, takedown requests
- Penalties or fines
...arising from or related to:
- Allegations that your submitted content infringes copyright, trademark, design rights, patents, publicity rights, privacy rights, or any other intellectual property right
- Allegations of defamation, harassment, obscenity, or harm caused by content you submitted
- Use of brand names, logos, characters, or likenesses you do not have rights to
- Misuse of the printed product by you or anyone you give it to
This means: if a third party sues us because of something you sent us to print, you are responsible for the legal costs and any damages.
4. We do not pre-screen for IP
ABHITA is a manufacturing service that processes a high volume of orders. We do not have the resources to verify intellectual property rights of every submitted file. We rely on customer warranties and the takedown process described in section 5.
Common examples of files that typically require permission include:
- Characters from movies, TV shows, video games, or comics (Disney, Marvel, DC, Nintendo, Pokémon, etc.)
- Sports team logos and player likenesses
- Brand logos (Apple, Nike, Coca-Cola, etc.)
- Designs marked "personal use only" being used commercially
- Designs from paid model libraries without a commercial license
- Likenesses of celebrities, politicians, or other identifiable persons
5. Notice and takedown
If you are an intellectual property rights holder and believe content commissioned through ABHITA infringes your rights, please send a takedown notice to legal@abhita.in with subject "IP TAKEDOWN" containing:
- Identification of the IP you claim has been infringed (with proof of ownership)
- Identification of the specific item commissioned at ABHITA (order ID if known, or a description)
- Your contact information (name, address, email, phone)
- A statement of good-faith belief that the use is unauthorized
- A statement, under penalty of perjury, that you are the rights holder or authorized to act on their behalf
- Your physical or electronic signature
On receiving a valid notice, we will:
- Halt any in-progress orders related to the disputed content
- Add the design to a do-not-print list
- Request indemnification from the original customer
- Cooperate with lawful investigations
6. Use of finished products
3D printed parts have inherent technical limitations:
- Layer adhesion: 3D prints can fail along layer lines under stress, especially perpendicular to print direction
- Dimensional tolerance: typically ±0.3mm, can be more for large parts
- Material properties: PLA softens at ~60°C, PETG at ~80°C, ABS at ~100°C — not heat-resistant compared to injection-molded parts
- UV/weather: PLA degrades in direct sunlight; PETG/ABS hold up better but not indefinitely
- Food contact: 3D prints have layer-line gaps where bacteria can grow. We do not certify food-grade or food-safe
- Medical/biological use: Not sterilized or biocompatible. Not for medical implants, dental devices, or anything contacting open wounds
- Structural/load-bearing: Not validated for load-bearing applications without independent engineering analysis
- Safety-critical: Not for use in firearms, explosives, vehicles, aircraft, or any safety-critical system without certification
By ordering, you acknowledge these limitations. ABHITA is not liable for injury, property damage, financial loss, or any consequence arising from the use, misuse, or failure of any printed item.
7. Custom design files belong to the customer
Designs you submit remain your intellectual property. We do not sell, redistribute, or claim ownership of customer files. We retain a limited license only to fulfill your order, including:
- Slicing and printing the file
- Storing the file for up to 12 months in case of reorders
- Photographing the finished print for our portfolio (anonymized — no identifying information; you may opt out)
8. Color and finish variation
3D printed parts may have:
- Visible layer lines (we use 0.2mm layer height by default; finer is possible at higher cost)
- Slight color variations between batches of filament
- Support material removal marks where supports were attached
- Minor stringing or imperfections inherent to FDM 3D printing
These are normal characteristics of 3D printing and not defects. Photos of products may show idealized prints; actual results may vary slightly.
9. Estimates are not guarantees
Our live price calculator and instant quote tool provide estimates only. Actual final pricing is confirmed by ABHITA staff after reviewing your specific file and requirements. See our Terms & Conditions for the quote workflow.
10. Third-party content
Our website may contain links to third-party websites (MakerWorld, Thingiverse, Printables, Razorpay, Google, Meta, etc.). ABHITA is not responsible for the content, privacy practices, or availability of these external sites. Use them at your own risk and review their respective terms.
11. Information accuracy
We strive to keep product descriptions, prices, and information accurate, but errors may occur. We reserve the right to correct any errors and reject orders based on incorrect information at any time before fulfillment.
12. Force majeure
ABHITA is not liable for delays or failure to perform caused by events beyond our reasonable control, including but not limited to: acts of God, fire, flood, earthquake, government regulations, civil disturbance, equipment failure, courier strike, COVID-19 / pandemic, or supply chain disruption.
